This page summarises the legal notice and the privacy policy of ecoEn GmbH. It describes what data we process when you use our website or contact us. This English version is provided for convenience; in the event of any discrepancy, the German version prevails.

Privacy policy

The protection of your personal data is important to us. Below, we inform you about what data we process, for what purpose and what rights you have. The basis is the revised Swiss Federal Act on Data Protection (revFADP) and – where applicable – the European General Data Protection Regulation (GDPR).

2. Collection and processing of personal data

We primarily process the personal data we receive from our customers and other business partners and from other persons involved in the course of our business relationship, or that we collect from users when operating our website and other applications. This includes in particular:

• Master data – name, address, email address, phone number
• Project data – building data, roof condition, roof area and orientation, electricity consumption, photos of properties for PV planning
• Contract and billing data – quotes, contracts, invoices, payment information
• Communication data – content of your enquiries via form, email, phone or WhatsApp
• Technical data – IP address, log files, device and browser information when visiting the website

3. Purpose of data processing

We use the personal data we collect primarily to conclude and perform contracts with our customers and business partners – in particular the planning, implementation and maintenance of photovoltaic systems, battery storage, heat pumps and charging stations. In addition, we process data to provide and improve our website, for customer communication, to fulfil legal obligations and for marketing purposes, provided you have not objected to the use of your data.

4. Provision of the website and server log files

Our website is operated by a hosting provider with servers located in Switzerland. When a page is accessed, your browser automatically transmits information that is stored in so-called server log files:

• Browser type and version
• Operating system used
• Referrer URL – the previously visited page
• Host name of the accessing computer
• Date and time of the server request
• IP address

This processing is technically necessary to deliver the website, ensure its stability and security and prevent misuse. We do not merge the log files with other data sources and do not analyse them on a personal basis.

5. Cookies and local storage

Our website uses cookies and similar technologies. Cookies are small text files stored on your device. We use:

• Technically necessary cookies – for operating the website, caching pages and security. Without them, the website does not work correctly.
• Analytics cookies – from Google Analytics 4 (see section 6). Depending on the cookie, these have a lifetime of up to two years.
• Local storage in the browser – we store technical values in your browser (local storage or session storage) to understand which page brought you to us and to pre-fill a contact form if needed. These values contain no names or contact details, remain on your device and can be deleted by you at any time via your browser settings.

You can block cookies in your browser generally or delete them selectively. Technically necessary cookies cannot be deselected without restricting the usability of the website.

6. Web analytics with Google Analytics 4

We use Google Analytics 4, a web analytics service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics uses cookies and similar identifiers to statistically analyse the use of our website – for example which pages are accessed, how long visitors stay and through which source they reach us. Among other things, your shortened IP address, device and browser data and approximate location information (country and region) are transmitted to Google and processed there.

We use these analyses exclusively to improve our website and content. Google may transfer the data collected to the USA; Google is certified under the EU-U.S. Data Privacy Framework and undertakes to comply with the EU standard contractual clauses.

You can prevent collection by Google Analytics by installing Google's browser add-on: tools.google.com/dlpage/gaoptout. Blocking analytics cookies in your browser settings is equally effective. You'll find more information on data processing by Google at policies.google.com/privacy.

7. Contact form, email, phone and WhatsApp

If you contact us via the contact form, by email or by phone, we process your details exclusively to answer your enquiry, prepare a quote and handle any resulting business relationship. The details submitted via the form reach us by email and are stored in our website system.

The phone number displayed on our website is linked to WhatsApp. If you click on it, you will be redirected to WhatsApp – a service of WhatsApp Ireland Limited (Meta). From that moment, WhatsApp's privacy provisions also apply; we have no influence on what data is processed there. If you don't want this, you can reach us at any time by email at info@ecoen.ch or by phone at the number above.

8. Solar calculator

Our solar calculator provides a non-binding initial assessment for your roof. The calculation itself takes place in your browser. However, to find your address and determine the suitability of your roof, your browser directly queries two public federal interfaces (api3.geo.admin.ch) – the address search of the Federal Office of Topography swisstopo and the roof area data of «Sonnendach» of the Swiss Federal Office of Energy SFOE. In doing so, the address you entered or the coordinates derived from it and your IP address are transmitted to these federal bodies. The servers are located in Switzerland.

Your entries in the solar calculator are only transmitted to us when you actively submit the result as a quote request. Until you do so, your details do not leave your browser in our direction.

9. Google Maps

On our contact page, we embed a Google Maps map to show you our location. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. When the map loads, your browser transmits your IP address to Google; Google may set cookies. If you are logged into your Google account at the same time, Google can assign the visit to your account. If you want to avoid this, log out of your Google account before visiting the contact page. More information: policies.google.com/privacy.

10. Disclosure of data to third parties

In the course of our business activities and for the purposes mentioned, we also disclose data to third parties – either because they process it on our behalf or because they use it for their own purposes. These include in particular:

• Subcontractors and installation partners – to carry out the installations
• Authorities, cantonal bodies and grid operators – for example for grid connection applications, building permits and incentives and one-off feed-in incentives
• IT service providers – hosting provider, software providers for PV design, email services
• Analytics and map services – Google (see sections 6 and 9)
• Advisory bodies – fiduciary, audit, legal advice, insurance

These recipients are mostly based in Switzerland but may also be located abroad. If a recipient is located in a country without adequate statutory data protection, we contractually oblige them to comply with a level of data protection equivalent to Swiss law – for example by means of the EU standard contractual clauses – or base the transfer on another statutory exception.

11. Retention period

We process and store your personal data for as long as is necessary to fulfil our contractual and legal obligations or for the purposes pursued with the processing – i.e. generally for the duration of the entire business relationship and beyond in accordance with the statutory retention and documentation obligations of ten years. Enquiries that do not result in an order are deleted as soon as they are no longer relevant to us. The usage data stored in Google Analytics is automatically deleted after the retention period set there.

12. Data security

We take appropriate technical and organisational security measures to protect your personal data against unauthorised access, loss and misuse. These include in particular continuous SSL/TLS encryption of our website, access restrictions to what is necessary and regular updates of our systems. However, complete protection when transmitting data over the internet is technically not possible.

13. Your rights

Within the framework of the data protection law applicable to you, you have the right to information, correction and deletion of your personal data, the right to restrict and object to processing, and the right to receive certain personal data for transfer to another body (data portability). If you have consented to processing, you can withdraw this consent at any time with effect for the future.

Please note that we reserve the right to assert statutory restrictions – for example if we are obliged to retain data or have overriding interests of our own. A message to info@ecoen.ch is sufficient to exercise your rights. To be able to assign your request, we may require proof of identity.

You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC): www.edoeb.admin.ch. Where the GDPR applies to you, you also have the right to lodge a complaint with the supervisory authority responsible for you.

14. Changes to this privacy policy

We may amend this privacy policy at any time to adapt it to changes in the legal situation or to changes in our services. The current version published on this page applies.
